Prosecutor Responds To Hartman Plea

Summit County Prosecutor Sherri Bevan Walsh says a killer who claims a jailhouse informant committed perjury at his trial hasn't offered enough evidence to warrant delaying his execution.

Walsh argues in an Ohio Supreme Court filing Monday that death row inmate Bret Hartmann has no basis for stopping his execution.  The 34-year-old Hartmann wants time to gather evidence of the alleged perjury and test other evidence he says will prove his innocence.

Hartmann also wants time to demonstrate that Ohio's method of lethal injection is unconstitutional.  Hartmann is scheduled to die April 7 for the 1997 fatal stabbing of 46-year-old Wanda Snipes. 

Walsh calls the perjury claim speculative and says there's no proof that testing new evidence would exonerate Hartmann.
 
Hartmann is also hoping Governor Ted Strickland will side with him.  The Ohio Parole Board previously offered an "unfavorable" recommendation to Hartmann's request for clemency, which is now in the governor's hands.

It is so ridiculous that once you are convicted of a crime, no one has any responsiblity to test new evidence! I believe this guy is probably guilty, but if we are taking his life, we should test every little shred of evidence...otherwise we run the risk of being murders ourselves!

Our justice system is supposed to be innoscent until proven guilty..good enough, but mistakes can happen and evidence miscounted sometimes purposefuly because someone needs to have some pat on the head for getting "the man" I dont know if this man is innoscent or guilty but had i been on th ejury initially and knowing evidence was with held I would be furious!

Its not like Mr. Hartmann is going to be foot-loose and fancy-free while this evidence is tested. He will be secure on death row and can be executed later. I do not favor capital punishment, but, if it is going to be done, it should be done with the utmost care to assure the right person is killed.

Bevan Walsh test all the evidence, after that do what you have to do.

To play devil's advocate here, if you're familiar with ALL the information (and not just the anti-execution Web sites' version), you will see that the "evidence" Hartmann is asking to be tested isn't being tested because it will be inconclusive. As originally noted in the case file, the condom could have been there for months, per investigating officers, and the hair could have come from any number of places. Plus, other evidence Hartmann has asked to be tested in the past was tested - and only furthered his guilt in placing him at the scene and increasing belief in his role in Wanda's death.

I have a very off feeling about this case in general. While I am not sure Hartmann was the man ultimately responsible, as there are some truly bizarre events surrounding the case (just one being the alleged threat from someone else toward Wanda that Bart mentioned - apparently, his alibi held because he was "home drinking beer with friends" - what kind of alibi is that?!?), the record of his behavior the evening Wanda was found is highly suspicious (he repeatedly called Wanda "a whore," hid behind a tree while officers investigated the scene, hid crucial evidence from officers, etc.).

Maybe Ohio should take a leaf out of New Mexico's book and eliminate the death penalty altogether until a more finite system of judgment, with no wiggle room for "possibilities," can be put in place.

I remember all three of these people from my days of living in Highland Square. Winda (correct spelling) was beautiful and always dressed up with nice clothes. Pleasant with a warm smile. Hartmann was clean cut (worked) and had a pleasant personality. Jeffry Nichols on the other hand was very weard and unkept. Don't get me wrong this does not make him a murderer. The fact that he had access to the keys to her apartment, (he was a maintainence person there) could point to him strongly. He had called her terrible names and threatened to slash her throat only a week or so earlier. As SANewsie stated above his alibi of being home drinking beer with his family just don't get it for me. I still contend that more testing and time may be in order in this case. Test the rest of the evidence Bevan Walsh. A man is going to die in a week.
